Waiver and Release of Liability:
I, the undersigned passenger, acknowledge that I have voluntarily chosen to participate in the tour provided by South Side Tours LLC (the Company). I am aware that participation in the tour involves inherent risks, including but not limited to, travel-related incidents, accidents, injuries, and illnesses.
In consideration of being permitted to participate in the tour, I agree to the following:
1. Assumption of Risk: I voluntarily assume all risks associated with my participation in the tour, including but not limited to travel risks, accidents, injuries, and illnesses.
2. Release and Waiver: I hereby release, waive, discharge, and hold harmless the Company, its owners, directors, officers, employees, agents, and assigns from any and all claims, liabilities, demands, or causes of action that I, my heirs, executors, administrators, or assigns may have arising out of or related to any loss, damage, injury, or illness that may be sustained by me during or in connection with the tour, to the fullest extent permitted by the laws of theState of Illinois and the City of Chicago.
3. Photo & Video Release Consent: By participating in a South Side Tours bus tour, I hereby consent to being filmed or photographed. I grant South Side Tours LLC the right to use my likeness in photographs, video, or other digital media (“photos”) in any and all of its publications, including web-based platforms, without payment or other consideration. I understand and agree that all such media will become the property of South Side Tours LLC and will not be returned. I irrevocably authorize South Side Tours LLC to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. I waive the right to inspect or approve the finished product wherein my likeness appears. I also waive any right to royalties or other compensation arising from or related to the use of the photos.
4. Indemnification: I agree to indemnify and hold harmless the Company from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney's, arising out of my participation in the tour.
5. Medical Treatment: I understand and agree that the Company is not responsible for providing medical assistance or treatment. I hereby release and hold harmless the Company from any claim arising out of any first aid, treatment, or service rendered in connection with my participation in the tour.
6. Compliance with Rules: I agree to comply with all rules and instructions provided by theCompany, its employees, and agents. I understand that failure to comply with such rules andinstructions may result in my removal from the tour without a refund.
7. Governing Law: This agreement shall be governed by and construed in accordance with the laws of the State of Illinois and the ordinances of the City of Chicago.
8. Severability: If any provision of this agreement is found to be unenforceable or invalid, that provision shall be severed from this agreement, and the remaining provisions shall remain in full force and effect.
9. Acknowledgment of Understanding: I have read this waiver of liability and hold harmless agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
